SWA Clinches Another Scotch Whisky Protection
The Scotch Whisky Association (SWA) has achieved landmark scotch whisky protection in Hong Kong. The license grants the organization trademark protection for the ‘scotch whisky’ category of whiskies. As a result, the term ‘Scotch whisky‘ may only be used for whisky produced in Scotland.
In addition, any whisky bearing the label must be blended with Scotch ingredients. At the same time, must be matured in Scotland for at least three years. In accordance with production and labeling guidelines, the raw materials include water, cereals, and yeast. All SWA whiskies are matured in oak casks.
In a brief press release, the SWA identified the Hong Kong liquor market as an important segment worth over $39 million. In the past, Scotch whisky protection was based on the law of passing off, which led to expensive and complex court proceedings for brands.

However, the new trademark agreement allows for immediate protection and elimination of possible ‘knockoffs’. Any Whisky brand desiring to use the ‘Scotch Whisky’title must receive approval from SWA. This agreement was among over 100 global markets that have granted similar license and trademark permits to Scotch whisky protection.
“Improving protection of Scotch whisky in developing markets is a priority for the SWA legal team, as consumers in these markets explore and expand their knowledge of Scotland’s national drink.
“Hong Kong’s recognition of the Scotch whisky certification trademark gives consumers in the market the confidence and certainty that what they are purchasing is the genuine quality product.” Lindesay Low is SWA’s deputy legal director.
Meanwhile, in an expression of gratitude to Hong Kong, Brian Davidson, British consul general stated:
“This milestone recognizes Scotch whisky as a symbol of Scotland’s rich heritage and craftsmanship. We are grateful for the continued appreciation shown by Hong Kong consumers – they can now have even more confidence in the provenance of Scotland’s beloved national spirit.”
